Terms & Conditions

1. Acceptance of Terms

By accessing kycis.com or using any KYCIS software product or API service, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of our website and services immediately. These Terms are governed by the laws of Alberta, Canada.

2. Services Provided

KYCIS Inc. develops and operates engineering software products for the oil and gas industry, including:

  • DPCloud: A calculation service for hydrocarbon dew point, water dew point, and phase envelope analysis, accessible via REST API or SCADA/OPC integration.
  • Custom Engineering Software: Purpose-built simulation and data tools developed under separate written agreements.
  • kycis.com website: A marketing and information website providing technical documentation, product information, and a contact channel.

All services are provided “as is” subject to these Terms and any applicable service agreement. Service availability and feature sets may change at our discretion with reasonable notice.

3. Use of the DPCloud API

Access to the DPCloud API requires a valid API key issued by KYCIS. By using the API, you agree to the following:

  • Authorized use only: API keys are issued to specific organizations or individuals and must not be shared, resold, or used for purposes other than those agreed upon with KYCIS.
  • Rate limits: API usage is subject to rate limits specified in your service agreement or communicated upon key issuance. Exceeding rate limits may result in temporary throttling or suspension.
  • Acceptable use: You may not use the API to reverse-engineer the underlying calculation algorithms, build a competing service, or conduct load testing beyond agreed parameters.
  • Data inputs: You are responsible for the accuracy of fluid composition and process data submitted to the API. Calculation results are only as accurate as the inputs provided.

4. Engineering Disclaimer

KYCIS software products, including DPCloud, are engineering tools intended to assist qualified professionals. The results produced by our software are based on thermodynamic models and the data you provide. They are not a substitute for independent professional engineering judgment.

KYCIS does not warrant that calculation results are free from error, suitable for any specific purpose, or compliant with any particular regulatory standard. Users are solely responsible for verifying results, applying appropriate safety factors, and ensuring compliance with applicable regulations and engineering codes of practice.

KYCIS shall not be liable for any decisions made, actions taken, or losses incurred based on results produced by our software.

5. Intellectual Property

All software, source code, algorithms, calculation methods, documentation, and website content created by KYCIS Inc. are the intellectual property of KYCIS Inc. and are protected by Canadian and international copyright law.

  • You may not copy, reproduce, modify, distribute, or create derivative works from KYCIS software or content without express written permission.
  • Access to the DPCloud API does not grant any license to KYCIS’s underlying intellectual property beyond what is necessary to receive and use calculation results.
  • Technical documentation provided for integration purposes may be used for that purpose only.

6. Confidentiality

If KYCIS and your organization have a signed non-disclosure or service agreement, the terms of that agreement govern the handling of confidential information and take precedence over these general Terms where they conflict.

In the absence of a separate agreement, you agree not to disclose any non-public technical specifications, pricing, or pre-release information shared by KYCIS in the course of evaluating or using our services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, KYCIS Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our website, software, or API services — including but not limited to production losses, pipeline incidents, equipment damage, regulatory penalties, or loss of profits — even if KYCIS has been advised of the possibility of such damages.

KYCIS’s total cumulative liability to you for any claims arising from or related to these Terms shall not exceed the total fees paid by you to KYCIS in the three months preceding the claim.

8. Website Use

You may use kycis.com for lawful purposes only. You must not attempt to gain unauthorized access to any part of our website or systems, introduce malicious code, or engage in any activity that disrupts or degrades website performance for other users.

9. Modifications to Terms

KYCIS reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised Effective Date. For API customers under an active service agreement, material changes will be communicated directly. Continued use of our services after the revised Terms are posted constitutes acceptance.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from these Terms shall be resolved in the courts of Alberta, and you consent to the exclusive jurisdiction of those courts.

11. DPCloud Interactive Demo (kycis.com)

KYCIS publishes a browser-based interactive demo of DPCloud on the kycis.com website. The demo lets visitors explore the phase envelope, hydrocarbon dew point, and water dew point behaviours of a simulated gas-processing pipeline, and try the DPCloud API from three code snippets (cURL, JavaScript, Python). The following additional terms apply to your use of that demo and supplement §3 (Use of the DPCloud API) and §4 (Engineering Disclaimer) above.

  • Synthetic data. Pipeline conditions, alarm states, setpoints, flow readings, and compositions shown in the demo are synthetic and do not reflect any real operational asset. The demo is not, and must not be treated as, a live SCADA or control system.
  • Free development keys. API keys obtained through the demo’s Integrate flow are free evaluation keys issued at KYCIS’s discretion and are rate-limited. KYCIS may throttle or revoke evaluation keys that show patterns consistent with automated load testing, scraping, or production use. Contact us for a production quota.
  • No embedding or redistribution. You may link to the hosted demo at kycis.com, but you may not embed the demo (via <iframe> or equivalent) in a third-party site, nor redistribute, host, or republish the demo’s front-end code, assets, or screenshots as part of a commercial product, without prior written permission from KYCIS.
  • Analytics. The demo collects privacy-preserving, cookieless analytics to help us improve it. What is collected, how it is processed, and how to opt out are described in the Privacy Policy under Analytics & Interactive Demo.
  • Engineering disclaimer still applies. Any output produced by the demo, including phase-envelope curves and dew-point values, is provided for illustration and evaluation only. The disclaimer in §4 (Engineering Disclaimer) applies in full to all such output: no decision affecting equipment, personnel safety, custody-transfer measurement, or regulatory compliance may be made solely on the basis of demo output.
